Crown appeals acquittal of man in deadly downtown Vancouver crash

The B.C. Prosecution Service has filed a Notice of Appeal after a man was acquitted for his part in a crash that claimed the life of a young child in 2021.

Seyed Moshfeghi Zadeh was found not guilty last month.

“On May 2, 2024 the B.C. Prosecution Service file a Notice of Appeal from acquittal in relation to this court file. We will have no further comment while the matter is before the BC Court of Appeal,” said Crown Counsel in a statement to CityNews.

Zadeh was charged with dangerous driving causing death and dangerous driving causing bodily harm in connection to the incident.

The crash happened at the intersection of Smithe and Hornby Streets in July 2021 when a Ford Escape collided with a McLaren which rolled and struck then-31-year-old Michael Hiiva and his 23-month-old daughter Ocean.

“As a result of the collision, one of the vehicles mounted the sidewalk and struck a man who was carrying his daughter. The child died immediately on scene. The father was taken to hospital for non-life-threatening injuries,” said Vancouver Police Cst. Tania Visintin at the time.

VPD said both drivers remained at the scene and Zadeh, who was 29 at the time of the collision, was arrested.
